Affiliate Program Terms of Service

Effective Date: April 19, 2026

By applying to or participating in the Mums Candy Affiliate Program (“Program”), you (“Affiliate”) agree to the following terms. Violation of any provision will result in immediate termination and forfeiture of all commissions.

1. Eligibility

Affiliates must operate legally compliant businesses and adhere to all applicable laws, regulations, and advertising platform policies, including but not limited to Google Ads, Meta Ads, and FTC guidelines.

2. Prohibited Advertising Practices

Affiliates are strictly prohibited from:

  • Making false, misleading, or unsubstantiated claims about products or results

  • Using exaggerated or unrealistic claims (e.g., “health benefits,” “miracle snacks,” or similar unsupported statements)

  • Promoting content that violates Google Ads policies, including:

    • Misrepresentation

    • Circumventing systems

  • Using fake reviews, testimonials, or impersonation

  • Creating bridge pages, cloaked pages, or misleading landing pages

  • Using clickbait, deceptive headlines, or disguised ads

3. Paid Advertising Restrictions

  • Affiliates may not run Google Ads (Search, Display, YouTube, or Performance Max) using:

    • The Mums Candy brand name, trademarks, or misspellings

    • Direct linking to the Mums Candy website without prior written approval

  • Affiliates are prohibited from:

    • Bidding on branded keywords

    • Attempting to outrank official Mums Candy ads

    • Using display URLs that misrepresent ownership

All paid traffic sources must be pre-approved in writing.

4. Compliance with Platform Policies

Affiliates must comply with all advertising platform rules, including but not limited to:

  • Google Ads Policies

  • Meta Advertising Standards

  • FTC Endorsement Guidelines (including clear affiliate disclosures)

Failure to comply—even if unintentional—will result in immediate removal.

5. Content Guidelines

All affiliate content must:

  • Be truthful, accurate, and non-deceptive

  • Clearly disclose affiliate relationships (e.g., “I may earn a commission from this link”)

  • Avoid unsupported claims regarding ingredients, sourcing, or benefits

  • Use only approved creatives, messaging, and brand assets when provided

6. Brand Usage

Affiliates may not:

  • Register domains, social media handles, or pages using “Mums Candy” or variations

  • Represent themselves as the company or an official brand account

  • Modify logos, trademarks, or brand assets

7. Monitoring & Enforcement

Mums Candy reserves the right to:

  • Monitor affiliate traffic sources, advertisements, and content at any time

  • Request immediate removal or modification of any non-compliant material

  • Suspend or terminate accounts without notice for violations

8. Commission Forfeiture

Any commissions generated through:

  • Policy violations

  • Misleading advertising

  • Unauthorized paid ads

…will be voided and unpaid.

9. Indemnification

Affiliates agree to indemnify and hold harmless Mums Candy from any claims, damages, or liabilities arising from their marketing activities or violations of these terms.

10. Termination

Mums Candy may terminate any affiliate at its sole discretion, with or without cause, effective immediately.

11. Updates to Terms

These terms may be updated at any time. Continued participation in the Program constitutes acceptance of the updated terms.

12. Governing Law

These Terms shall be governed by the laws of Michigan.

By participating in the Affiliate Program, you acknowledge that you have read, understood, and agreed to these Terms of Service.
